LOS ANGELES, Calif. (WSAU) – The Menendez brothers are set to return to court for the first time in nearly three decades as they hope to convince a judge to reduce their sentences and allow them to go free.

According to the New York Post, during a status hearing on Monday, Erik and Lyle Menendez, who are currently in prison for life without the possibility of parole, will ask Judge Michael Jesich to weigh new evidence that their father’s alleged sexual abuse caused the shotgun murders of their parents in 1989 in their Beverly Hills home.

Judge Jesic has not yet decided whether they will appear from prison in person or virtually. In addition, the brothers’ lawyers will ask for their sentences to be commuted from first-degree murder to manslaughter, which would result in the reversal of their 50-year to life sentences at the Richard J. Donovan Correctional Facility near San Diego, California.

According to new testimony, including claims by Roy Rossello, a former member of the boy band Menudo, that he was raped by the brothers’ father Jose while he was a music executive at RCA Records, the Menendez brothers’ lawyer Mark Geragos also asked California Gov. Gavin Newsom for a pardon. which would allow them to leave prison almost immediately. Governor Newsom delayed consideration of his request until newly elected Los Angeles District Attorney Nathan Hochman could review their case and make a recommendation.

Netflix documentary “Monsters: The Lyle and Erik Menendez Story” ranked No. 1 on Netflix’s Top 10 Films in the World (English) for the week of October 7-13, with 22.7 million views and 44.7 million hours watched , is one of many media outlets that have covered the high-profile case in recent weeks, as former Los Angeles District Attorney George Gascón said their sentence should be commuted to ensure their immediate release.

The brothers are scheduled to appear in Los Angeles County Superior Court today at 12:30 pm CST, with a resentencing hearing scheduled for December 11.
