Solar Lawyer Responds to Motion to Disqualify in Fraud Case

Lawyers representing former Power Home Solar LLC CEO William Jason Waller have urged a Michigan federal judge to reject a motion to disqualify them from a fraud and racketeering lawsuit. Lawyers at DarrowEverett LLP said Wednesday that the plaintiffs’ conflict-of-interest claims have no legal or factual merit and are an ill-timed tactic designed to undermine the defense.

Response to Solar Atty DQ: No grounds for disqualification

In their response, filed in the U.S. District Court for the Eastern District of Michigan, DarrowEverett said their past in-house legal work for Power Home Solar, a company renamed Pink Energy and now defunct, did not create a conflict of interest that prohibited them from representing Waller.

The firm rejected the plaintiffs’ allegations as baseless, saying none of DarrowEverett’s current or former clients objected to their representation of Waller.

“Plaintiffs’ reliance on the alleged conflict of interest is not for the benefit of DarrowEverett’s current or former clients, but rather is an untimely smokescreen to remove the firm from this action for the convenience of plaintiffs,” the response states.
