Eric Menendez And Lyle Menendez failed to appear in court when a judge rescheduled his murder trial.

Eric, 53, and Lyle, 56, were scheduled to attend a court hearing remotely in Los Angeles on Monday, November 25. Judge Michael Jesic said he needed more time to get to the bottom of the case and would not be ready by Dec. 11, the original date for a formal hearing. He rescheduled hearings on the new sentence for January 30 and 31.

Us weekly confirmed that Eric and Lyle “heard everything” but never showed up in court due to technical problems with the prison communications channel.

Eric and Lyle were arrested in 1990 on two counts of first-degree murder after their parents, Kitty and Jose Menendez, were found shot to death in their home. The siblings later admitted to killing their parents after years of alleged physical, emotional and sexual abuse. They were ultimately found guilty and sentenced to life in prison without parole in 1996 after two high-profile trials.

Although their previous attempts to appeal the decision were rejected, recent high-profile TV projects such as Monsters, Menendez Brothers and many others seemed to offer Eric and Lyle a chance at freedom. In October, Los Angeles District Attorney George Gascon recommended the judge resentence Eric and Lyle to 50 years, which would make them eligible for parole and release from prison.

“I won’t talk about whether (Eric and Lyle) have a plan (after their potential release from prison). I just think that in order to get through each day, you just need to be grounded,” their lawyer. Mark Geragos exclusively told Us at that time. “It’s a long journey from living without parole for almost 17 years to hope.”

The request has since become more challenging since Gascón lost his re-election bid earlier this month. District Attorney Elect Nathan Hochmantakes office on December 2. After Eric and Lyle also applied for clemency, Gov. Gavin Newsome said he would delay a decision to allow Hochman to review the case after taking office.

Monday’s status hearing took into account two new pieces of evidence that were not presented during Eric and Lyle’s original trials that support their allegations of sexual abuse by their father. The petition quotes the singer Roy Rosselloaccusations against Jose and a recently discovered letter Eric wrote to his cousin. Andy Cano describing the alleged sexual abuse of his father in the months before the murders.
