The Supreme Court upheld the Kerala HC’s order that the state cannot refuse work for the mere registration of an FIR

The Supreme Court upheld the Kerala HC’s order that the state cannot refuse work for the mere registration of an FIR

He cited the Supreme Court judgment in Satish Chandra Yadav v. Union of India and Ors.

In this ruling, the Court noted that “neither the seriousness of the criminal offense nor the ultimate acquittal thereof was relevant in considering whether a trainee who conceals a material fact (his involvement in a criminal case, in personal information provided to the employer) is fit to continue as a trainee.” .

However, in this case, the Court stated that the provision of law in Satish Chandra Yadav is not inconsistent with the decision of the Kerala High Court.

However, he also left open the question of law raised by the state.

The question of law raised by Mr. Harshad V. Hameed, learned counsel for the appellant State remains open for consideration in the appropriate case.“, he added.
