Muskogee man sentenced to life in prison for first-degree murder, parole possible

On Thursday, a jury found Anthony Fisher guilty of first-degree murder and premeditation.

Fisher was sentenced to life in prison with the possibility of parole in the Oklahoma Department of Corrections, Assistant District Attorney Shawn Waters said.

On September 7, 2023, officers responded to a shooting at 1633 Center Lane in Muskogee. Upon arrival, officers saw James McNack III lying on the ground with gunshot wounds.

Maknak was later pronounced dead at a nearby hospital.

At the scene, officers were able to recover bullet fragments and spent casings, which reportedly contradicted witness accounts.

After serving a search warrant, officers found one of the two guns used in the murder.

Investigators later discovered that Fischer was a suspect, so he was charged.

Assistant District Attorney Shawn Waters stated, “Thanks to the efforts of the Muskogee Police Department, the OSBI Forensic Laboratory and the Oklahoma State Medical Examiner’s Office, we were able to determine that Anthony Fisher’s initial statement was false and that he was in fact the person who shot James Maknaka III. Without their efforts, this act of violence would have gone unsolved and there would have been no justice for Maknaka’s family.”
