A decision in the Menendez brothers’ case will be made by the end of the week, prosecutor George Gascón said.

Los Angeles County District Attorney George Gascón says he will make a decision on the Menendez brothers’ possible resentencing by the end of the week.

The news comes after weeks of renewed attention on the high-profile case, thanks in part to the release of Ryan Murphy’s drama series “Monsters: The Lyle and Erik Menendez Story” and a documentary about the brothers, both on Netflix. Lyle and Erik Menendez were sentenced to life in prison without the possibility of parole for the 1989 murders of their parents, Jose and Kitty Menendez.

Prosecutors argued the killings were motivated by greed. Defense attorneys argued that the killings were committed in self-defense following the brothers’ claims that they were sexually and physically abused by their father – claims that prosecutors at the original trial said were fabrications. After a mistrial in those proceedings, the brothers were convicted at a second trial, in which their lawyers felt that evidence of abuse had been excluded.

Gascón said his office is divided on whether they believe the claims.

He said he has been investigating the case for a year and plans to make a decision by the end of the day Friday. He said renewed interest in the case has sped up the decision-making process.

The Menendez brothers’ appellate lawyers filed a petition for habeas in May 2023, citing new evidence — a letter from Erik Menendez to a relative in which he detailed alleged abuse by his father — to challenge his conviction. The district attorney said he is reviewing the letter along with allegations of abuse against Jose Menendez made by Roy Rosselló, a former member of the boy band Menudo. The group had a recording contract with RCA Records, where Jose Menendez worked as an executive.

He says he’s been studying the case for a year and expects to make a decision by the end of the day Friday, even though a hearing in the case is already scheduled for late November. He says renewed interest in the case has sped up the decision-making process.

The habeas petition that led to the November hearing was filed by appellate attorney Cliff Gardner in May 2023, when new evidence was first discovered – a letter from Erik Menendez detailing alleged abuse against a family member. He also cited similar allegations made by Roy Rosselló, a former member of the boy band Menudo, which was managed by RCA, where Jose Menendez worked as an executive.
