A MAN has been jailed after he went on a violent rampage when he saw his brother and wife having sex in the back of a car while his mum was in the driver’s seat.

David McCulloch, from Tasmania, was sentenced to three years in prison after pleading guilty to multiple charges of assault, possession of cannabis and possession of a homemade firearm.

The 41-year-old man was sentenced on Friday after he shouted death threats at his family while brandishing a shovel on March 28.

Court documents say McCulloch tried to call his wife Jacinta King several times that day and became suspicious when no one answered, The Daily Mail reported.

The couple lived with David’s mother, Sue, and it emerged that she had taken King to the home of her eldest son, Jamie McCulloch.

Sue picked him up and drove her son and daughter-in-law to a nearby car park where they began having sex in the back of the car while she stayed in the front.

McCulloch found his wife and brother and immediately began punching his brother before attacking his wife, pushing her out of the car and punching her in the head.

As Jamie tried to flee the scene, McCulloch began beating him with a shovel he had taken from the car, saying he would “kill them all”.

When Sue tried to stop her sons fighting, she was pushed back into the bin.

Jamie eventually managed to leave the area and, in frustration, McCulloch broke a shovel on a car and used it to beat his wife before punching her in the eye.

The couple had been in a relationship for 25 years, married for six, during which time they had four children and found a suitable match. tattoos.

McCulloch was arrested and taken to Devonport Police Station after neighbours called the police.

Meanwhile, his wife and brother were taken to Mercy Community Hospital with bruises and minor cuts.

During an interview with police, the scorned husband showed no remorse for his attack, saying his brother “deserved it.”

He also admitted to having homemade firearms and ammunition at his home.

A search of his home revealed 240 grams of cannabis in ziplock bags, which he admitted selling and delivering, as well as an unsecured firearm located in a pile of laundry.

“MORALLY PROVOCATIVE”

During the sentencing in Burnie Supreme Court On Friday, Judge Tamara Jago said the scene McCulloch encountered in the car park as he searched for his wife was “confrontational”.

Jago said: “The betrayal of your wife and brother and the apparent acquiescence of your mother must have been upsetting.

“And while it is understandable that this would have caused some concern and disappointment, this in no way justifies what you did then.

“However, it puts your behavior into context.

“This was not intentional or planned behavior, but rather a spontaneous reaction to discovering a difficult situation involving a breach of trust.”

The judge noted that while McCulloch intended to cause grievous bodily harm to his brother, “the actual harm caused was moderate” as many of the shovel blows missed his body.

She called the violence “exceptionally serious” and told McCulloch he “reacted in the most inappropriate manner” to the “morally provocative” incident.

“But I accept that this was an emotional response to the circumstances that you discovered,” she added.

The judge ruled that McCulloch was unlikely to reoffend and this, coupled with his early guilty plea, meant he was sentenced to three years’ imprisonment and a $1,000 (£512) fine.

However, the final 18 months of that sentence will be suspended unless he commits any other crimes within two years.

Because the sentence is backdated to May 7, he is eligible for parole in February.
